Save Boca Laws Are Constitutional and Reflect Those in Many Florida Cities

TO THE RESIDENTS OF BOCA: THE SAVE BOCA LAWS ARE CONSTITUTIONAL AND YOU WILL HAVE THE OPPORTUNITY TO VOTE THEM INTO LAW SOON.

MANY CITIES THROUGHOUT FLORIDA HAVE LAWS THAT DIRECT PUBLIC LAND SALES AND LEASES TO REFERENDUMS AND OUR CITY WILL TOO.

City of Fernandina Beach

  • A referendum election is required prior to the sale or lease for a period of more than 40 years of recreational facilities: golf courses, swimming pools and parks

  • The referendum must pass by 70% of the voters in the referendum election


City of Clearwater

  • No municipally owned real property which was identified as recreation/open space on the city’s comprehensive land use plan map may be sold, donated, leased or otherwise transferred without prior approval at a referendum.


City of St. Petersburg 

  • Long term leases and sales of waterfront or park property requires approval by referendum


City of St. Pete Beach

  • Public playgrounds, recreations centers, swimming pool or libraries can only be disposed of in any way upon specific authorization of a majority vote of a city-wide referendum.

Florida courts, including the controlling precedent from the 4th District Court of Appeals, have already overruled the Palm Beach County circuit court on electorate’s right to a referendum prior to the sale of property, expressly ruling this does not violate home rule in Florida. 

We have a responsibility, especially after what came out this year, to pass through the Save Boca laws for our city: now, for our children and all future generations of Boca Raton. 

Never again will our public land and parks be put at risk once we pass these laws. This is the biggest fight of our generation and together we will prevail and Save Our City.  Thank you to all of the citizens for rising to the occasion and fighting for our city's future.
